The Service includes access to premarket levels for observation in futures markets, market analysis, educational content, and related tools for futures trading purposes.
By accessing or using the Website or Service, you (“you” or “your”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website or Service. These Terms form a legally binding contract between you and us. You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.
We may update these Terms from time to time. Significant changes will be posted on the Website with the new effective date, and we may notify subscribers via email. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
1. Description of the Service
The Service provides subscription-based access to:
- Premarket levels posted for observation in futures markets. These levels are shared for informational purposes only and are not trading signals or recommendations.
- Market analysis reports, educational resources, and webinars focused on futures trading.
- A user dashboard for viewing posted levels, historical data, and personalized recommendations.
What is Not Included:
- Direct trading execution or brokerage services.
- Personalized financial planning or tax advice.
- Guarantees of performance, accuracy, or relevance of posted levels.
- Any directive on how to trade or act on the observed levels.
2. User Eligibility and Registration
To use the Service, you must:
- Be at least 18 years old and legally capable of entering contracts.
- Provide accurate, complete, and current information during registration.
- Not be prohibited from receiving our Service under applicable laws (e.g., residents of sanctioned countries).
We reserve the right to suspend or terminate accounts for violations of these Terms or suspicious activity.
3. Subscription and Payments
3.1 Subscription Plans
We offer various plans (e.g., monthly, annual) with different levels of access (e.g., basic level observations vs. premium analysis). Details, including pricing, are available on the Website and may change with notice.
3.2 Billing and Payments
- Subscriptions are billed automatically upon sign-up and renew at the end of each term (e.g., monthly).
- All fees are in Canadian Dollars (CAD) unless otherwise stated, exclusive of taxes (which you are responsible for).
- Payments are processed via third-party providers (e.g., Stripe, PayPal). You authorize us to charge your payment method for renewals.
- We do not store full payment details; recurring billing uses secure tokens.
3.3 Cancellations and Refunds
- You may cancel your subscription at any time via your account dashboard or by emailing support@theprometheusinitiative.ca. Cancellation takes effect at the end of the current billing period; no prorated refunds.
- Refunds are not provided except as required by law (e.g., 14-day cooling-off period for new subscribers in certain jurisdictions). To request a refund, contact us within the applicable window with your reason.
- No refunds for partial access or dissatisfaction with the utility of posted levels.
3.4 Failed Payments
If payment fails, we may suspend access until resolved. Repeated failures may result in account termination.
4. User Conduct and Responsibilities
You agree to:
- Use the Service only for lawful purposes and in compliance with these Terms.
- Not misuse the Service, including (but not limited to):
- Reverse engineering, copying, or distributing posted levels or content without permission.
- Sharing account credentials or reselling access.
- Posting harmful content, spam, or infringing material (if user-generated content is allowed).
- Using automated tools to scrape data.
- You acknowledge that posted levels are for observation only and are not infallible or advisory. Trading futures carries risks, and you bear full responsibility for your decisions, best practices, and any losses.
- Do not represent our posted levels as your own analysis or use them for commercial purposes without a separate license.
5. Intellectual Property
All content on the Website and in the Service—including posted levels, analyses, graphics, software, and trademarks—is owned by us or our licensors and protected by copyright, trademark, and other laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes during your subscription. This license ends upon termination.
You may not reproduce, modify, distribute, or create derivative works from our content without written consent. Any feedback you provide becomes our property (with no compensation to you).
6. Disclaimers and No Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- Posted levels and analysis are based on our methodologies but are not guaranteed accurate, timely, relevant, or useful for trading.
- We do not endorse any securities or investments mentioned.
- The Website may contain links to third-party sites; we are not responsible for their content or practices.
- We disclaim liability for interruptions, errors, viruses, or data loss.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim. This limitation applies regardless of the legal theory (contract, tort, etc.).Some jurisdictions do not allow these exclusions; in such cases, liability is limited to the maximum extent permitted.
8. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, losses, damages, or expenses (including attorneys’ fees) arising from:

9. Termination
9.1 By You
You may terminate your account and subscription at any time, subject to Section 3.3.

- Legal requirements or safety concerns.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of laws principles. You submit to the exclusive jurisdiction of the courts in Toronto, Ontario, for any disputes.
Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If unsuccessful, you agree to binding arbitration under the rules of the ADR Institute of Canada, unless we elect to pursue remedies in court for injunctive relief (e.g., IP infringement).Class Action Waiver: You waive any right to participate in a class action or representative proceeding.
11. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the full agreement between us.
- Severability: If any provision is invalid, the remainder remains enforceable.
- Waiver: No waiver of any term is a continuing waiver.
- Assignment: We may assign these Terms; you may not without our consent.
- Force Majeure: We are not liable for delays due to events beyond our control (e.g., natural disasters, cyberattacks).
